Consumers in the European Union market can take advantage of the unique and clinically supported benefits of magnesium L-threonate thanks to the European Union's decision to grant North American ingredient supplier, AIDP, the rights to use the supplemental magnesium in products sold across the EU. The license, which was granted on the basis of proprietary data exclusive to the company, allows AIDP and its partner company and licensee ThreoTech, manufacturers of magnesium L-threonate under the trademark name Magtein and sublicensees, to market magnesium L-threonate in the EU for a period lasting five years starting from November 7, 2024. Magtein is appropriate for use in capsules, RTD beverages, snack bars, gummies, gels, and powders. Magnesium L-threonate is a safe, bioavailable source of magnesium, and a fully approved novel food option for consumers interested in magnesium supplementation.

Exclusive Rights

Unless a subsequent applicant obtains an authorization without reference to the protected proprietary data, the marketing of magnesium L-threonate as a novel food in the EU will require prior approval by AIDP, and, as its licensee, ThreoTech. Any company looking to market magnesium L-threonate during the period of exclusivity will be required to take a license from ThreoTech and source the magnesium L-threonate directly from them. Additionally, any company that is currently selling magnesium L-threonate as a novel food throughout the European Union without a license issued by ThreoTech is now required to halt all sales and touch base as soon as possible. In order to thwart any attempts at avoiding licensing obligations, the company has retained Herbert Smith Freehills, a leading global law firm, to pursue companies in the EU that infringe the exclusivity granted by the novel food approval.
